You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for any activities or actions under your account.

3.2 Account Security

You must notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to maintain account security.

4. Service Access and Data Integration

4.1 FedEx Account Integration

To use our Service, you must connect your FedEx shipping account to PigeonAI. You authorize us to access your FedEx shipping data, invoices, tracking information, and related shipping records necessary to provide our Service.

4.2 Data Authorization

By connecting your FedEx account, you grant PigeonAI permission to:

Access and analyze your shipping data

Review invoices and billing information

Identify potential refund opportunities

Generate reports and insights based on your shipping activity

4.3 Third-Party Services

We are not affiliated with, endorsed by, or sponsored by FedEx. Your use of FedEx services is subject to FedEx's own terms and conditions.

5. Subscription Plans and Billing

5.1 Free Tier

PigeonAI offers a free tier for up to 1,000 parcels per month. The free tier includes basic analytics and insights as specified on our pricing page. We reserve the right to modify the free tier parcel limit at any time with reasonable notice. While we may allow you to continue accessing your data after exceeding your monthly parcel limit, continuous or excessive usage beyond your plan limits without upgrading may result in:

Application of overage surcharges

Requirement to upgrade to a paid plan

Temporary restriction of service access

You will receive notice before any surcharges are applied or forced upgrades are implemented.

5.2 Paid Subscriptions

Paid subscription plans are billed on a recurring basis (monthly or annually) as selected during signup. All fees are non-refundable except as required by law or as expressly stated in these Terms.

5.3 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel prior to the renewal date. We will charge your payment method on file for the renewal period.

5.4 Price Changes

We reserve the right to modify our pricing with at least 30 days' notice. Price changes will take effect at the start of your next billing cycle after the notice period.

5.5 Taxes

All fees are exclusive of applicable taxes, which you are responsible for paying.

6. Refund Recovery Services

6.1 Service Options

PigeonAI offers two refund recovery options:

Self-Service: We identify potential refund opportunities and provide you with information to claim refunds directly with FedEx

Managed Service: We handle the entire refund claim process on your behalf

6.2 Success Fees

For managed refund recovery services, we charge a success fee based on recovered refunds as specified in your selected plan. Success fees are only charged on successfully recovered refunds.

6.3 No Guarantee

While we work diligently to identify and recover eligible refunds, we do not guarantee any specific refund amount or success rate. Refund eligibility and approval are determined solely by FedEx according to their policies.

6.4 Authorization

By using our managed refund recovery service, you authorize PigeonAI to submit refund claims to FedEx on your behalf and to represent your interests in the refund process.

7. User Responsibilities and Prohibited Conduct

7.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

Violate any applicable laws or regulations

Infringe upon the rights of others

Transmit any malicious code, viruses, or harmful materials

Attempt to gain unauthorized access to our systems or other users' accounts

Use the Service to engage in fraudulent activity

Reverse engineer, decompile, or disassemble any part of the Service

Use automated systems or software to extract data from the Service (scraping)

Interfere with or disrupt the Service or servers connected to the Service

7.2 Data Accuracy

You are responsible for ensuring that the data you provide and the shipping information we access on your behalf is accurate and belongs to you or your organization.

8. Intellectual Property Rights

8.1 Our Property

The Service, including all content, features, functionality, software, and underlying technology, is owned by PigeonAI and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

You retain all rights to your shipping data. By using our Service, you grant us a limited, non-exclusive license to use, process, and analyze your data solely for the purpose of providing the Service to you. We may use aggregated, anonymized data derived from all users' shipping information to generate benchmarks, industry insights, and recommendations that improve the Service for all users. This aggregated data does not identify you or your business individually.

8.3 Feedback

If you provide us with any feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without any obligation to you.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PIGEONAI, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your access to or use of or inability to access or use the Service

Any conduct or content of any third party on the Service

Any content obtained from the Service

Unauthorized access, use, or alteration of your transmissions or content

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR $100, WHICHEVER IS GREATER.
